Letter of Liability

The Credit Department of the San Antonio Express-News requires a Letter of Liability to determine the party responsible for the debt incurred when an advertiser uses an advertising agency to place advertising in our newspaper.

It is important to know to whom credit is being granted when two or more parties are involved in the placement of advertising. An advertising agency may have a long-term relationship and excellent credit standing with our newspaper, but the advertiser may be new or not in good credit standing. Or the situation may be reversed with the advertiser in good credit standing and the advertising agency may be new or not in good credit standing.

The San Antonio Express-News allows an advertising agency to sign a blanket Letter of Liability stating that the advertising agency is responsible for payment for all advertising placed by the agency.

If the advertising agency is unwilling to sign a Letter of liability or if the advertising agency is not credit worthy, the advertiser must sign a Letter of Liability stating that they, the advertiser, are responsible for payment of the debt.

The Credit Department of the San Antonio Express-News strives to keep paperwork requirements to a minimum, but good business practices and the Sarbanes-Oxley Act of 2002 require obtaining a Credit Application from the party receiving credit, and in the case of multiple party transactions, a Letter of Liability to know which party is responsible for payment.
